I have two comments about this.First, as the trsanferable nil rate band is not yet law, perhaps the clients should be warned that, if this government does not last until next July, it may never become law.Secondly, you advise your clients that have wills with a nil rate band trust not to change them. I think this is generally the right advice, with one caveat: the trustees might be unable to agree on appointing funds to or for the surviving spouse, so that the trsanferable nil rate can be taken. This is more likely to occur if the spouses are in second marriages and the trustees include a child from each previous marriage. This might be particularly serious if the nil rate band is increased to a31m.
